DEFECTIVE PRODUCTS: Confidential Settlement in Motorcycle Helmet Case

 

Douglas C. Weinstein and Norbert J. Slovis, of Slovis, Rutherford & Weinstein, represented Dale Wade Morgan, who was catastrophically injured in a motorcycle accident. While driving on Clinton Highway in Knoxville, a car pulled out into Dale's path. His motorcycle "T-boned" the car, Dale was thrown over the handlebars. His Arthur Fulmer helmet, manufactured by an Italian company called Fimez, came off his head befor he struck the ground. He suffered extensive head injuries, was in a coma for several days following the accident, had to learn to speak all over again, and suffers from partial paralysis on his right side.

Investigation of the helmet revealed that the buckle on the chin strap disengaged whenever force -- such as what happens when one is thrown over the handlebars -- is applied to it. Doug retained helmet experts and mechanical force experts from New Orleans, Louisiana and Philadelphia, Pennsylvania to help prove the case. He even accompanied the helmet to Los Angeles so that he could ensure that the helmet cmpany's experts would not damage the evidence during their inspection of the helmet.

Ultimately, the case settled at mediation for a confidential sum, before a trial date was even set.
