FAMILY LAW IN KNOXVILLE AND EAST TENNESSEE

People get divorced for a number of reasons, whether because of incompatibility, the discovery of an affair, or even just falling out of love over the passage of time. Your choice of a Knoxville divorce lawyer or family law attorney is critically important, however.

We understand that going through the divorce process may be the most difficult thing you have ever done. Our job is to help take the burden of marital dissolution off your shoulders, as much as possible. We look into all aspects of East Tennessee and Knoxville divorce situations: appropriate division of assets; fair child custody and visitation arrangements; and proper alimony and child support.

There are three ways to legally end a marriage under Tennessee divorce law:

  • Irreconcilable Differences ("No-Fault" or Uncontested Divorce) -- you and your spouse agree on all the major issues, such as property, custody, visitation and support. We can help with the details, as well as making sure the legal documents are properly drafted.
  • Contested Divorce -- If you and your spounse can't agree on the issues, or if your spouse objects to the divorce, you can ask the court to rule. You must allege one or more of the following grounds: inappropriate marital conduct; adultery or drug addition; abandonment and non-support; or living apart -- without sexual relations -- for at least two years. A contested divorce may take a year or more to complete.
  • Divorce by Legal Separation -- If you and your spouse separate and get an Order of Legal Separation, yopu may become divorced two years after that legal separation, without a further trial or other cooling-off period. You still have to show grounds for separation, and you have to work out the major issues at the time of the legal separation.
