NEGLIGENCE/PERSONAL INJURY: $550,000 Personal Injury Settlement

 
Slovis, Rutherford & Weinstein reached a full and final settlement in the case of Estate of Alford Ford, Deceased, et al. v. Cappo Management III, Inc., et al. Principal Douglas C. Weinstein acted as co-counsel for the plaintiffs, along with Reid Troutman of Troutman & Troutman, P.C. in LaFollette, Tennessee.

On October 15, 2000, Alford Ford, his step-son Ronnie Irvin, and Mr. Irvin's wife Meary Ann, were struck by a motor vehicle with license plates from East Tennessee Dodge in LaFollette. The striking vehicle was driven by Leslie Smith, an employee of the car dealership, who allegedly had permission to drive the vehicle that evening. Mr. Smith told police after the collision that he had consumed at least six beers in the hour prior to the collision. Mr. Smith was a three-time convicted drunk driver, whose license had been revoked, and who was classified by the state of Tennessee as a habitual motor vehicle offender. The dealership was aware that Smith had prior DUI convictions and no driver's license, yet nonetheless allowed him routinely to drive dealer vehicles.

As a result of the collision, Alford Ford, age 79, suffered a broken neck, which required two surgeries to stabilize. During the surgeries he suffered strokes that caused paralysis and disorientation. His condition directly led to his death two weeks after the collision.

Ronnie Irvin suffered, in addition to cuts, lacerations and soft tissue injury, a major stroke caused to a significant degree by the depression and stress over losing his beloved stepfather.

Meary Ann Irvin suffered soft tissue injury, as well as severe post-traumatic stress disorder, arising from seeing her husband and stepfather-in-law lying before her in the vehicle, in a pool of blood.
